TERMS & CONDITIONS

  • This is a translation of our Spanish "Terms & Conditions" (Condiciones generales de compra) as a rough guide only. The Spanish text only is legally binding.
  • These are the general terms & conditions that apply to contract relationships that ADVANCED DIVING TECHNOLOGY S.L. (hereinafter ADITECH) offers in this web site. The offered products are related to diving and/or divers.
  • Following the steps to buy a product in the Aditech web site means that you agree with the general buying conditions that appear herein.

PURPOSE

The purpose of the following general buying conditions is to distribute the products offered in the Aditech web site, in exchange of money.

CONTRACT FORMATION

The user agrees with the general buying conditions presented in this text, once he registers on the Website.

ORDER RECEIPT, PRICE AND PAYMENT

  • The price for each product is shown in the shopping cart of the web site.
  • The price and conditions may change, but the user will receive the price and conditions dated the moment of the order. This applies except when there is a pricing error on the web site.
  • Aditech reserves the right to charging the order from the moment it has been received.
  • We must be notified of any order cancellations or changes before 12.00 (Spanish time) after the order has been placed. After this time the order is considered completed. During this period of cancellation, the customer can cancel the order with no additional costs incurred. If the order is cancelled after this period of time and it has been shipped already, Aditech will charge the customer for the transport expenses incurred for the cancellation.
  • To receive a product from Aditech, the user will have to pay by:
    • Credit Cards: Visa or Mastercard
    • PayPal: payments by PayPal have a surcharge of 2.5% over the total value of the order
    • Direct Bank Deposits
    • Bank Electronic TT SWIFT IBAN wire transfer remittance.
  • Aditech reserves the right to request a bank transfer when they decide to do so.
  • Aditech charges the invoices only in Euros at the exchange rate of the day of the customer has placed the order. Customers might be affected by the difference of the exchange rate between the moment they were charged and the moment their own bank charges them. This small difference can work for or against the benefit of the customer and cannot be controlled by Aditech. As such Aditech does not accept any responsibility.
  • In the event that a product is mistakenly listed at an incorrect price, ADITECH reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. ADITECH reserves the right to refuse or cancel any such orders whether or not the order has been confirmed.

SHIPPING COSTS

  • The shipping costs for each order is shown in the shopping cart on the web site and can be seen clearly before the purchase is made.
  • The goods always travel at buyer's risk.
  • Aditech will verify that the payment has been made correctly and then will send the product the following way:
    • By POST:registred mail or air parcel. All products in stock are delivered to your home within approximately 1 to 2 weeks.
    • By UPS Standard or EMS: All products in stock are delivered to your home within approximately 3 - 5 working days. If you live outside the USA zone it could take 10 - 14 working days.
  • Saturday, Sunday and bank holidays are considered as non working days. If due to any error on our part, the shipping takes longer than indicated, Aditech will contact the customer to notify them of this delay and will propose any alternative solutions. Maximum delivery times apply only for products in stock. You can see on the website if a product is in stock.
  • The buyer or a designated person will have to be at the address provided to us to accept and sign for delivery of the package when the package is delivered. If there is nobody there to receive the package, the shipping agency will attempt to deliver the package two more times. After this time, the package will be sent back to Aditech. 

INVOICE/TICKET

  • When the final user has made a purchase, Aditech will give him a ticket.
  • When an enterprise has made a purchase, Aditech will give him an invoice.
  • In both cases in the invoice the taxes and the shipping costs will be broken down.
  • In both cases, the ticket and/or the invoice will be sent in the same package as the purchased product.

PRODUCT WARRANTY

All products offered by Aditech are warranted. If a product sold by Aditech has a manufacturing fault or is broken during shipping, Aditech will repair it with no extra charge, exchange it for a new one, or give a refund. In these situations, the shipping costs incurred for the exchange or return will be paid by Aditech. The buyer must inform by e-mail within 7 days of receiving the order that he wishes to return a product so that the best delivery procedure can be arranged. Otherwise additional costs incurred will be the responsibility of the customer.

Aditech provides a limited warranty to the original purchaser of MANGROVE products against all defects in original workmanship and material under normal SCUBA use and service as outlined in the owner's manual for 2 years from the date of purchase, and 1 year for products of other brands not manufactured by Aditech, with the following exceptions:
  • Should your equipment prove to be defective for any reason (other than those listed in the limitations section below) it will be repaired or replaced at Advanced Diving Technologies´ discretion, free of charge, excluding shipping and handling charges.
  • Repairs made under this warranty will not extend the warranty period
  • This warranty is non-transferable and applies to the original purchaser only.
  • All correspondence concerning this warranty must be accompanied by a copy of the original sales receipt.
  • Any flood or damage, for any reason, that is caused from flooding an O-ring sealed or water tight area will not be covered under warranty. All O-ring sealed products undergo extensive factory pressure testing before being shipped and delivered and are therefore guaranteed to be sealed and functioning when shipped from the factory.
  • All batteries and chargers are warranted by the original battery/charger manufacturer.
  • Lithium Ion battery packs are warranted for 6 months
  • Aditech will not be liable for any loss, damages, or expenses including incidental or consequential damages directly or indirectly arising from the sale or use of the product.
  • All paint finishing, cosmetic discoloration of surfaces, powder coating, or material stitching that is chipped, damaged, or unthreaded through customer use is not covered in the warranty.
  • Aditech does not warranty any product for aesthetic finishes. Issues with surface finish that do not affect function of the product are not covered under warranty.
  • This warranty does not apply and may be rendered completely void in the event of accidental damage, abuse, overcharging of battery, flooding due to neglect, tampering, lack of care and maintenance, improper storage, or unauthorized service.
  • This warranty specifically excludes bulbs, lenses, cords, wet connectors, O-rings, fuses or other conditions resulting from misuse and negligence.
  • This warranty specifically excludes spare parts that are mounted or installed by the customer, like bulkheads, hot shoe brackets, hot shoe plugs, etc.
  • This warranty becomes void if the equipment components are damaged by anything other than normal recreational diving use.
  • Modifications or repair by anyone other than an authorized ADITECH Dealer or ADITECH Service Department will void the warranty.
  • By purchasing this product you agree and understand that in no event will ADITECH, its distributors or retailers, be held liable for any personal injuries resulting from its operation, or any other damage whether direct, indirect, incidental or consequential, even if ADITECH is advised of such damages. 
  • Please note the warranty on underwater housings does not cover damage to your camera caused by water leakage. It is your responsibility to insure your equipment with a specialist underwater equipment insurance company

RETURNS & REFUNDS

  • If an item does not meet with your satisfaction for any reason, you are welcome to return it. You must obtain an RMA. You must notify us by email to info@aditech-uw.com of your desire to return your purchase within 14 days after the package has been received and it must be returned within 15 days of issuance of an RMA.
  • Returned items must be the same item in the same condition as originally shipped, the unit must be unused and returned in the original packaging, including any accessories, manuals, and documentation.
  • IMPORTANT: Please do not put tape or stickers directly on the original product packaging
  • ADITECH has 7 days from receipt of the returned unit to examine and verify the unit has not been used in any way.
  • Returns should be shipped insured.
  • Refunds are for the final purchase price only. Shipping charges for the delivery of an order won't be reimbursed.
  • Shipping costs, insurance, and handling charges (if any) are non-refundable.
  • A credit will be issued as soon as we receive and process your return.
  • Please allow up to two billing cycles for a refund to appear on your credit card statement.
  • We do not pay for return shipping but will pay shipping on the replacement item for domestic orders.
  • International buyers pay shipping both ways.
  • If you return for a refund any items that were originally delivered to you under the terms of a free standard shipping offer then we will deduct from your refund our fee for Ground delivery.
  • Returns sent postage/freight collect will be refused.
  • Once issued, RMA numbers are valid for 15 days.
  • ADITECH must receive the returned products within this timeframe. RMA numbers will not be extended or reissued.

Are there some items I cannot return?

  • No refunds of products and accessories for discontinued items or that have been specifically imported at the customer's request
  • No refunds of products specifically manufactured and customized according to the requirements of the customer, such as Mangrove video housings, ROVs, underwater CCTV cameras, etc.
  • No refungs on video and photo housings, front ports and lenses that are specially ordered for a client.
  • No refunds on spare parts

Can I return unsuitable items and is it free?

  • Unsuitable goods can only be returned in an unworn/unused state within 14 days after the package has been received.
  • Please securely wrap your parcel and send to the address below.
  • We do not pay for return postage in this case; this will be at your own cost.
  • Please remember that the products are your responsibility, as a customer, until they reach us. For your own protection, we recommend that you send any returns by a postal/courier service that provides insurance for the value of the goods, a dispatch certificate or document and a signed proof of delivery.
  • Please retain your Certificate of Posting and hold onto it until you have received your refund from us. You will be refunded by the payment method used for your original purchase.

How can I know that my return has been received?

  • It usually takes around 10 working days for your parcel to be received and processed.
  • If you complete your email details when you place your order, we are able to send you an email as soon as we receive your returned items.

How can I change my product for another?

  • In case you wish to exchange an item within 14 days upon delivery of the products, the buyer will pay the cost of the return. Once we receive the merchandise in our warehouse and ensure that all the above conditions exist, the returned product will be admitted and will proceed to refund the amount according to the method of payment.
  • The customer must make the request of the new product directly through our online store or physical store.

How and when will I receive my refund?

  • Once your return is received at our office and inspected by the Returns department (usually within 72 hours of receipt), your refund will be processed and a credit will be automatically applied to your credit card or original method of payment within 10 days
  • Once managed the return, you receive the money in your account between 4 and 10 days depending on the approximate method of payment and the bank. Note that the packages are opened by order of arrival. We try to not be much but it may delay your return a few days later.
  • Refunds relating to these returns will be made pursuant to the payment method used to pay the order.:
    • If you made the payment through credit card, the amount will be paid on the same credit card
    • If payment made by bank transfer, we will request an account number where to pay the amount
    • If you made the payment through PayPal, the amount will be paid on the same PayPal account.

What should I do if I receive the wrong item?

  • Believe it or not we do make mistakes on the odd occasion! If we've sent you a part which is different to what is listed on your invoice we will happily exchange it and return postage will be at our expense.
  • If you receive a wrong item you can return the product within 14 days upon delivery of the products.
  • To return, just send us an email to info@aditech-uw.com and then we will send you an email with instructions to follow for the return shipping

What should I do if I receive a defective item?

  • If the item you have ordered is defective, contact us within the 7 days after the package has been received and we will replace the defective item for you with an item of equal or greater functionality.
  • Outside of 7 days only manufacturers warranties (if any) apply. 

What should I do if I receive a damaged item during shipping?

  • We do everything in our power to ensure that your goods arrive in perfect condition but if there is a problem with faulty or damaged goods during shipping, please notify us in writing by email to info@aditech-uw.com within 5 days after you've received your order.
  • When you receive your package, make sure that the product has not been damaged during transport. The package must be received in good condition, otherwise, note this fact on the delivery note, turning away the shipping and notify within 24 hours to info@aditech-uw.com email indicating the order # and email.
  • If no external signs of having suffered any damage during transport, and after signing the bill of transport, open and check the merchandise. In case of spoilage or non-compliance due to transport (which are not apparent at the time of delivery), it shall notify through the email info@aditech-uw.com during 5 calendar days upon receipt of order.
  • It is important to remember that we only have 5 calendar days to implement the insurance, so should communicate these facts within this period. Once we receive your email, you will receive an email with instructions to follow for the return shipping.

How do I prepare my parcel for return?

  • In order to return an order make sure that it meets all the requirements:
    • It is within the prescribed period: up to 14 days from receipt of order.
    • You sent us an email to info@aditech-uw.com indicating the order #, email and the reason for return and you got our email with instructions to follow for the return shipping
    • Item must be in original packaging and perfectly packed to prevent damage during transport. This requires that the products are protected by an additional outer packaging, as received at home.
    • The item must be in perfect condition and without being used.
    • The item must be shipped with all documentation and accessories including labels, instruction book, CD, etc.
    • Item must be returned with a copy of the communication sent emails info@aditech-uw.com
    • Please add to your parcel, a copy of the invoice and the guarantee certificate
    • The package must be sent carriage paid: ADITECH - Advanced Diving Technology SL Urb Mas Vilà - C / Balears, 26. 17252 St. Antoni de Calonge - Girona - Spain.
  • Once your return is received and inspected by the Returns department (usually within 72 hours of receipt),your refund will be processed and a credit will be automatically applied to your credit card or original method of payment within 10 days. Please note that depending on your credit card company, it may take an additional 2-10 business days after your credit is applied for it to post to your account.
  • Please, remember that freight collect packages will not be accepted. 

VAT REFUND

Passengers with habitual residences outside the European Union, or in the Canary Islands, Ceuta or Melilla, are entitled to Value Added Tax (VAT) refunds on their purchases made in the rest of the national territory. To request this refund, the total value of the goods purchased for each invoice should be greater than €90.15. The purchased goods should be taken outside the European Union within three months following their purchase.
Once you arrive at the airport, before checking in your baggage, go to the customs office and show:
  • Your passport or identification document (the addresses of residents of the Canary Islands, Ceuta and Melilla should be included on their DNIs).
  • The invoices to be stamped.
  • The purchased goods  
  • Your boarding pass or receipt from the company you are travelling with.
Once the invoices have been stamped, there will be two ways for you to obtain the refund:
  • Send the invoices to the establishment where you purchased the goods, who will then refund you the VAT.
  • Directly receive the refund in VAT refund offices located in the boarding area of the airport, once you have passed through the security checkpoint, if necessary. This refund is subject to a fee.
If during your travels you stop off in another airport before leaving the EU, you will need to stamp the invoices in the last airport.

POST-SALES SERVICE

  • Aditech offers repairing and maintenance service upon the products purchased in Aditech in exchange of money.
  • To use this service the user must contact Aditech previously.
  • All items send for repair during and after the warranty period should come with postage paid, must be perfectly packed and contain a note indicating the failure or anomaly detected and a list of accessories attached.
  • After assessing the type of failure, the customer will be informed of the cost of repairing for acceptance, in the case the customer refused to repair the item, then Aditech will bill the customer €50 for diagnostic expenses.
  • If within six months from the notification of the repairing charges, the customer does not request the return postage due of the item, ADITECH will proceed with the disposal of it.

PROTECT INFORMATION

  • Aditech offers all required information about its products and about its orders.
  • The buyer has to fill out the order application forms following all Aditech indications.
  • Aditech will protect the information of personal details according to the law.
  • The buyer has to pay the price of the product with the corresponding taxes and shipping costs.

GOVERNING LAW AND JURISDICTION

  • The contract will be interpreted, construed and enforced in all respects in accordance with the laws of Spain and you and Aditech irrevocably submit to the jurisdiction of the Courts of Girona in Spain.
  • In addition to this, Aditech is adhered to the Consumer Arbitration System (Sistema Arbitral de Consumo) and thus abides by The Arbitral law (Ley de Arbitraje). This system consists of a voluntary extrajudidicial procedure that is used when solving any dispute.The judgement by arbitration must be upheld and abided to the same as a judgment by a judge in a court of law.

MINOR PROTECTION

Any purchase is only authorised to those who are of age or to minor with authorisation from a parent or guardian.

COMMITMENTS

Aditech is committed to:

  • Always providing truthful information, to the best of our knowledge.
  • Not sending commercial information without first pointing out that they are of a commercial nature.
  • Answering the questions, complaints and suggestions within one week and, if delayed, contacting the customer to communicate a new waiting time for the answer.
  • Establishing an easy procedure for complaints.
  • Providing real time information regarding any order when required.
